Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Athlete", or "Coach") and PeakFlow, developed and maintained by Francesco Modesti ("we", "us", or "our"), an independent developer based in Italy, governing your access to and use of the PeakFlow application and any associated mobile or desktop applications (collectively, the "Service").

By creating an account or using the Service you confirm that you are at least 16 years of age and have the legal capacity to enter into this agreement. If you are accessing the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Description of Service

PeakFlow is a B2B2C software-as-a-service (SaaS) platform that provides:

  • AI-generated training plans tailored to individual athlete profiles, goals, and physiological data.
  • Coach tools that allow certified or professional coaches to manage athletes, review AI recommendations, and override or customise training sessions.
  • Telemetry integration via third-party providers (including Strava, Garmin, and Suunto) for automatic sync of activity data.
  • Daily check-ins and progress tracking including AI-driven feedback and recalibration suggestions.

3. No Medical Advice — Important Disclaimer

PeakFlow is a software tool for sports training management. It does not constitute medical advice, diagnosis, or treatment, and it is not a substitute for the advice of a qualified physician, physiotherapist, or other licensed healthcare professional.

The training plans, heart rate zones, load calculations, and AI-generated recommendations provided by PeakFlow are based on general sports science principles (including the Karvonen formula) and the data you provide. They are informational in nature and may not be appropriate for your specific health condition.

You should:

  • Consult a doctor before starting any new exercise programme, especially if you have a pre-existing medical condition, injury, or cardiovascular risk factor.
  • Stop exercising and seek medical attention immediately if you experience chest pain, dizziness, shortness of breath, or other unusual symptoms.
  • Not rely solely on PeakFlow output for decisions related to injury management, return to sport after illness, or overtraining syndrome.

PeakFlow, its developer, affiliated coaches, and AI systems expressly disclaim all liability for any injury, health event, or adverse outcome arising from following training plans or recommendations generated by the Service.

4. User Accounts & Roles

PeakFlow supports two user roles:

  • Athlete: an individual who uses the Service to receive and follow personalised training plans.
  • Coach: a professional or semi-professional who uses the Service to manage one or more Athletes, review plans, and provide human oversight to AI recommendations.

You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You must notify us immediately at francesco1000.ff@gmail.com of any unauthorised use of your account.

5. Coach Responsibilities

If you use PeakFlow as a Coach, you acknowledge and agree that:

  • You are solely responsible for the coaching advice, plan modifications, and guidance you provide to Athletes through the platform.
  • PeakFlow AI recommendations are suggestions only. You retain professional responsibility for any plan you approve or modify.
  • You will not misrepresent your qualifications or certifications to Athletes.
  • You will handle Athlete data with care and in accordance with our Privacy Policy.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable regulation.
  • Attempt to gain unauthorised access to other users' data or accounts.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Scrape, harvest, or systematically extract data from the platform via automated means without our express written consent.
  • Upload or transmit malicious code, spam, or any content that infringes third-party intellectual property rights.
  • Misuse the telemetry integrations in violation of the respective provider's Developer/API Agreements (e.g., Garmin Connect Developer Agreement, Suunto API Agreement, Strava API Agreement).

7. Subscription & Billing

PeakFlow offers tiered subscription plans ("Basic", "Pro Coach", "Enterprise"). Pricing, features, and billing cycles are detailed on the pricing page. Subscriptions renew automatically unless cancelled before the renewal date.

All fees are exclusive of applicable taxes. You authorise us to charge your payment method on file for recurring subscription fees. Refunds are provided at our discretion in accordance with applicable consumer protection laws.

We reserve the right to modify pricing with at least 30 days' notice. Continued use of the Service after the effective date of a price change constitutes acceptance.

8. Intellectual Property

All content, design, software, algorithms, and trademarks of PeakFlow are the exclusive property of Francesco Modesti and his licensors. You are granted a limited, non-exclusive, non-transferable licence to use the Service for personal or internal business purposes in accordance with these Terms.

You retain ownership of all data you upload (athlete profiles, training logs, etc.). By using the Service you grant us a limited licence to process that data solely for the purpose of delivering the Service as described in our Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by applicable law, PeakFlow and its developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or personal injury — arising out of or in connection with your use of the Service, even if advised of the possibility of such damages.

Our aggregate liability for direct damages shall not exceed the total fees paid by you to PeakFlow in the twelve (12) months preceding the claim.

10. Termination

You may terminate your account at any time by contacting francesco1000.ff@gmail.com. We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for an extended period.

Upon termination, your right to use the Service ceases immediately. Sections 3, 8, 9, and 11 survive termination.

11. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of Italy, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 60 days, disputes shall be submitted to the exclusive jurisdiction of the courts of Treviso, Italy.

12. Changes to These Terms

We may update these Terms periodically. We will provide at least 14 days' notice of material changes via email or an in-app notification. Continued use of PeakFlow after the effective date constitutes your acceptance of the revised Terms.
